Abstract

On March 16, 2009, Father Javier Giraldo wrote a letter about his moral impediment, or conscientious objection, in response to the subpoena to testify issued by the Fiscal Seccional 216. In the letter, the argumentative use of testimonial narration is constructed as a critique of the use of testimony in the legal procedures of the Colombian State, and it’s a determining reference in the configuration of conscientious objection as a fundamental right in constitutional jurisprudence.
